Default bean bag shells and rubber bullets

I'm not sure if this is the right area to post this but
I was wondering what the legal use of these are for home defense. If I shot a burglar un my home with say two bean bags back to back. Just to make sure be wasn't getting up anytime soon. Could I be charged with assault with a deadly weapon.

It is probably best to consult an attorney but the only time you should be pulling the trigger on a firearm is when your life is in danger. If you shot someone in the back to stop them from getting up you are probably going to be in trouble, even if it was with a bean bag round.

I'm only asking because I bought a few for my girlfriend to use .she said she could never fatally harm someone. Including burglars.and there is a rise in burglaries and home invasions in my area . Sorry for my grammar. We also have a few kids that's why I made sure I got her something she would use.

Sorry I didn't mean literally in the back. I meant more like a double tap.

A bean bag round is going to hurt like hell but it surely isn't going to stop someone. If they don't turn and run after being hit with a bean bag gun then lethal force would probably have to be used.

Yeah I know a bean bag shell ain't stop a pilled out addict in their tracks. But two to the chest should knock the wind out of them long enough to get the kids to safety.then break out the real guns.
Atleast I like to believe that. Hope I never find out.

Please keep in mind that even a bean bag can kill at close range or if it hits a person in the wrong place. (We had a kid die in Rochester a few months ago while playing lacrosse, from taking a ball in the chest. Stopped his heart.)

If your girlfriend is morally unable to kill someone even to defend herself or the children, she needs to not point a gun at anyone. Aside from the trauma it could cause her personally if the perp dies, the law doesn't distinguish between "I only meant to hurt him" and "it was him or me." If he dies and she pulled the trigger, she better have an airtight reason.

I'm sorry to be such a wet blanket, but taking up a gun in defense is a big responsibility.

If you have a real need to defend yourself it isn't a need to defend yourself halfway.

Dave brings up a very valid point. I also wouldn't want someone in possession of a firearm if they know they couldn't use it with lethal force. It would be tragic to have a weapon used against your own family member by a criminal.
