    I'm no lawyer, but does S-1863/A-3268 on page 14 make NYS a "shall issue" state? It seems like it will also replace the character references with a NICS background check. I must be reading it wrong?

    That's what it looks like. It deletes "by any person when proper cause exists for the issuance thereof" from the exiting law, then goes into great detail about how fingerprints are to be taken, searched, and filed on issuance of the license. NICS isn't the only background check; Albany and the FBI are both provided sets of prints for searches, and the state Health Department gets to weigh in with mental health records.
